Compliance in iGaming Influencer Marketing: What Operators in LATAM Must Get Right

Gambling promotion by creators sits at the intersection of country regulation, platform rules and ad disclosure. A practical compliance guide for iGaming operators in LATAM.

Influencer marketing has become one of the most effective acquisition channels for casinos and sportsbooks in Latin America. But it has a particularity that separates it from other verticals: a poorly executed campaign does not just waste budget, it can cost a license, a fine or a forced content takedown.

The industry's turning point came when Twitch restricted streams of unlicensed gambling sites in 2022, forcing operators and creators to professionalize how online betting is promoted. Since then, the question is no longer whether compliance matters, but who is managing it inside your campaign.

The three layers of compliance in creator marketing

An iGaming creator campaign operates at the intersection of three different frameworks, and all three must be satisfied at once:

    1. Each country's advertising regulation. Every GEO defines what can be promoted, who can promote it and with which warnings. Mexico requires authorizations under the SEGOB framework; Peru regulated online gambling in 2022 with its own advertising rules; Chile is moving toward its regulatory framework; and Argentina regulates at the provincial level. What is legal to communicate in one country may be prohibited next door.

    2. Platform policies. Twitch, YouTube, TikTok and Kick have their own rules on gambling content: which formats are allowed, which sites can be shown and which audience restrictions apply. These policies change frequently and operate independently of local law: content that is legal in Mexico can still violate a global platform's rules.

    3. Advertising transparency. The commercial relationship between brand and creator must be disclosed (paid content labels, advertising mentions), and gambling promotion must include responsible gambling messaging and age restriction (18+) according to the market.

    What this means in practice

Translated into the daily operation of a campaign, compliance implies concrete decisions:

    - Briefs with built-in rules: which claims are prohibited (no "guaranteed winnings"), which disclaimers are mandatory and which calls to action are acceptable in each GEO. - Age and geo targeting: gambling content must target adult audiences in jurisdictions where the operator can offer its services. - Contracts with compliance clauses: the creator commits to specific formats, messages and disclosures, with clear consequences for deviations. - Continuous monitoring: verifying that published content actually complies with what was agreed, and a correction or takedown protocol when something goes off track.

Why this is a competitive advantage, not just protection

Operators that internalize compliance do not just avoid risk: they build a more durable channel. The campaigns that survive are the ones platforms have no reason to take down and regulators have no reason to question. In a sector where trust is the core asset, promoting transparently and responsibly is also better marketing.

Serious creators prefer to work this way too: their credibility with their community is their business, and transparent promotion protects it.

What your agency should do for you

If you work with an agency for iGaming creator marketing, compliance cannot be an annex: it must be inside the service. At minimum, demand that the agency delivers briefs with each GEO's advertising rules integrated, creator contracts with disclosure and responsible gambling clauses, monitoring of published content and a response protocol for violations.

    Miela Insight

At Miela we treat compliance as part of the product, not as fine print. Every iGaming campaign we manage in Chile, Peru, Mexico, Argentina or any other market includes the country's betting promotion rules inside the creator brief: what can be said, in which format and with which disclaimers. Our creator contracts include advertising disclosure and responsible gambling messaging, and we monitor published content throughout the campaign.

For an operator, this means creator acquisition that scales without exposing the license or the brand. Performance and compliance do not compete: they are built together.
